By accessing or using the HyperCluster blockchain network, Quipu Protocol storage services, website, or any related services (collectively, the "Services") provided by HyperCluster ("we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

HyperCluster provides:

  • HyperCluster Blockchain: A high-performance EVM-compatible blockchain network powered by Hyperledger Besu
  • HYPEC Token: The native utility token for gas fees, staking, and rewards
  • Validator Program: Managed and self-hosted validator node participation
  • Quipu Protocol: Decentralized storage network with personal storage tiers
  • USDT Bridge: Cross-chain transfer services

3. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you:

  • Are at least 18 years of age
  • Have the legal capacity to enter into these Terms
  • Are not located in a jurisdiction where use of our Services is prohibited
  • Will not use our Services for any illegal purpose

4. User Responsibilities

You are responsible for:

  • Maintaining the security of your wallet and private keys
  • All activities that occur under your account or wallet
  • Ensuring your use of the Services complies with applicable laws
  • Understanding the risks associated with blockchain technology and cryptocurrencies
  • Backing up your data and recovery phrases

5. Prohibited Activities

You agree not to:

  • Use the Services for money laundering, terrorist financing, or other illegal activities
  • Attempt to disrupt, hack, or compromise network security
  • Store illegal content on Quipu Protocol
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Engage in market manipulation or fraudulent activities
  • Use automated systems to abuse the network

6. HYPEC Token

HYPEC is a utility token used for:

  • Paying transaction (gas) fees on the HyperCluster network
  • Staking to participate in network validation
  • Earning rewards for Quipu Protocol node operation
  • Paying for storage on Quipu Protocol

Important: HYPEC is not an investment. We make no guarantees about its value or future utility. You acknowledge the inherent volatility and risks of cryptocurrency tokens.

7. Validator Program

Participation in the validator program is subject to:

  • Approval by HyperCluster
  • Compliance with validator requirements and guidelines
  • Staking the required amount of HYPEC
  • Maintaining node uptime and performance standards

We reserve the right to modify validator requirements or remove validators who fail to meet standards.

8. Quipu Protocol Storage

By using Quipu Protocol:

  • You retain ownership of your stored data
  • You are responsible for your data's legality and compliance
  • Free tier (5GB) may have usage limitations
  • Paid tiers are subject to payment terms
  • We may suspend service for violation of these Terms

9. USDT Bridge

Use of the USDT bridge involves:

  • Cross-chain transaction risks
  • Potential delays in processing
  • Bridge fees as disclosed at time of transaction
  • Compliance with applicable regulations

10. Intellectual Property

HyperCluster retains all rights to:

  • The HyperCluster and Quipu Protocol brands and trademarks
  • Website content and documentation
  • Proprietary software (excluding open-source components)

Open-source components are licensed under their respective licenses.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Merchantability and fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Security against all threats

12. Limitation of Liability

To the maximum extent permitted by law, HyperCluster shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or cryptocurrency
  • Damages arising from unauthorized access to your wallet
  • Network downtime or technical issues
  • Third-party actions or smart contract failures

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless HyperCluster, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Modifications

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance. We will notify users of material changes through our website or email.

15. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, provisions that should survive (including limitations of liability and indemnification) shall remain in effect.

16. Governing Law

These Terms are governed by applicable laws. Any disputes shall be resolved in accordance with the applicable jurisdiction.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and HyperCluster.
